Is Wild Pines a Residential or Commercial Property?

Dear Wild Pines Owners,

Some owners have approached Board members that they have been told/questioned by other owners that Wild Pines is a “commercial property” and that this effects their personal insurance on their individual unit.

The Board requested the Association attorney to review our documents, and their legal analysis is as follows:

“We have reviewed the Association’s original Declaration of Condominium, the Amended and Restated Declaration recorded in 2016, and the 2018 amendment. Wild Pines was created as a condominium under Chapter 718, Florida Statutes, and the Declaration limits the units to residential use and prohibits commercial activity. The Declaration has also allowed owners to rent their units from the start, subject to the leasing rules, so rentals have always been part of how the community operates. Renting a unit in line with those rules is a normal residential use and does not change the character of the property.

We also confirmed with the Lee County Property Appraiser how the property is classified. The units are classified as condominium units and the common areas as residential common elements. Both are residential classifications.

Based on all of the above, Wild Pines of Bonita Bay is a residential condominium, not a commercial property, and there is nothing owners need to do to bring their units or the common areas into “commercial” compliance because of the rentals.”

The Board hopes this clarifies the false information that was shared.
